Abstract/Summary

According to Senator Loren Legarda, hazing has laid claim to many lives, and will continue to do so unless we take concerted action. These tragic untimely deaths prove that hazing remains a serious problem in fraternities, sororities, and other organizations in the country. The Anti-Hazing Law in its current incarnation is evidently not enough.;

Since its passage twenty years ago, Republic Act 8049 or the Anti-Hazing Law of 1995 does not cover all cases of hazing, thus it is deemed inefficient in serving its purpose of shielding or protecting the society from the violence inside organizations specifically the violence involved in initiation rties or rituals. Despite of its existence, such acts of violence unceasingly flourish with minimal convictions.

In observance of the aggravating circumstances under the Revised Penal Code of the Philippines, it is important to be taken into account that this mandate by the law is part of a general law and is the basis for the special laws, and if those special laws are silent as to the circumstance the Revised Penal Code suppletorily governs.

The society seeks to end the cycle of violence among organizations specifically the violence involved in the initiation rites or rituals of organizations. This thesis aims to study the applicability of the necessary aggravating circumstances under the Revised Penal Code in instances when alcoholic beverages are forcibly administered against the will, without the consent, or without any knowledge of the neophytes during hazing to deem it as an additional punishment under the Anti-Hazing Law of 1995 (R.A. 8049).
