Abstract/Summary

This research was conducted to determine if same-sex marriage is applicable in our country. The research questions are the following: Whether or not same sex marriage is violative of the 1987 Constitution? Whether or not Articles 1 and 2 of the Family Code run counter to Article 3, Section 1 of the 1987 Philippine Constitution? Whether or not same-sex marriage is contrary to Section 2, Article 15 of the 1987 Philippine Constitution

Even if the Family Code of the Philippines clearly defines marriage as a permanent union between a man and a woman, the constitution is unclear on the concept of marriage between homosexuals.

This research was done to interpret the provisions of the Constitution regarding marriage and its applicability to homosexual couples.
