Abstract/Summary
The 1987 constitution guarantees the people to form associations of any kind for purposes not contrary to law specifically the Right to Association clause. Barangay elections should be non-partisan as written in Article VI Section 38 of the Batas Pambansa Bilang 881 (BP. 881), otherwise known as the Omnibus Election Code. A non-partisan election requires that no person should represent any political party or any other organization in the elections.
Isn't this requirement of law prohibiting a person to file his certificate of candidacy in the barangay elections if he is a representative of any organization violative of the right to association clause? Isn't this also a violation of the right of the person to express one's self? Is this prohibition a valid exercise of Police Power?
