Abstract/Summary
In cases of Illegal dismissal the employee is unjustly terminated from his work. The Philippine constitution regards work or employment as a property of the individual. The Supreme Court however has not been firm on its stand and decisions regarding the payment of backwages or indemnity to an illegally dismissed employee.
This study will seek to find out the most equitable and justifiable policy and decision in determination of payment of backwages.
