Abstract

The Bouncing Check Law is not a new piece of legislation having been enacted as Batas Pambansa Blg. 22 in 1979. This law had filled the dockets of the courts because the act of issuing one worthless check is considered as criminal and proof, although still beyond reasonable doubt, is facilitated by the law itself. Even now, the provisions and the intent of this law require understanding considering that the issuance of checks is a normal and frequent business transaction. There are, moreover, judicial pronouncements about the law that ordinary persons may not be aware of, but should know nonetheless in their personal dealings with checks.
