Abstract/Summary
This study aims to apply the best interest of the child principle in custody and guardianship cases in the Philippine context and to set guidelines that will help the family court judges and social workers to have a common approach in determining to whom the custody or guardianship of a child should be awarded. The study examines the different approaches and understanding of the family court judges, social workers, psychologist, teachers and principals to the different characters, attitudes and wellbeing of a child. Furthermore, such examination involved the understanding of the needs of the children based on their ages and environment in order to mold themselves to become good and responsible persons of this society, through a holistic approach. The over-all result of the interviews that were conducted is that it is difficult to set specific guidelines in custody or guardianship cases because each case is different and unique from the other. However, the goal in proposing guidelines is to set a common approach on specific issues that the persons involved in awarding custody and guardianship are in conflict with. Moreover, the existence of guidelines would also encourage guardians or custodians to strive more to become fit for the duties of a custodian or guardian, which would ultimately be for the best interest of the child. Lastly, the said guidelines may help for faster rendition of judgments.
