Abstract/Summary

The right to the highest attainable standard of health is a basic human right recognized by all civilized countries. This right should be enjoyed by all human beings especially the poor and underprivileged. In line with this, the Philippines adhered to this principle and mandated itself to fulfill, promote and protect this right through its public hospitals and services.

However, in an attempt to save funds and modernize the delivery of public health care service, the Philippine government, through privatization, tends to transfer the obligation to deliver this basic social service to private and profit seeking entities. On the other hand, health activists and public interests groups strongly opposed the privatization scheme claiming that it violates the right to health of the people. Mainly, the privatization and corporatization of public hospitals will further marginalize the poor.

With this, there is no doubt that the Philippine government is confronted with a serious problem of balancing of interests between its duty to provide accessible, free and adequate health care services vis a vis the necessity to modernize and improve the quality of public hospitals.

It is submitted that when the government is faced with a situation of choosing the interest of the indigent patients’ right to health and the necessity to save government funds, the government must and should always be ready to tilt its scale of priority to fulfill and protect the right of its people.
