Abstract/Summary
The Interim Rules of Procedure on Corporate Rehabilitation is a guide to the RTC Commercial Courts Judges in hearing Corporate Rehabilitation cases. Nevertheless, there are still ongoing crucial problems that the corporate rehabilitation stakeholders are encountering in the RTC-Commercial Courts, mainly expertise and quality of decisions. Therefore, this study aims to explore the possibility of applying non-traditional approach in handling Corporate Rehabilitation cases. Utilizing scholarly journals, articles, foreign ADR programs, and expert opinion of the stakeholders in corporate rehabilitation, this study confirms the applicability of Alternative Dispute Resolution to resolving disputes in a corporate rehabilitation case. Data revealed that by resolving disputes within the corporate rehabilitation case, it would increase the chances of the parties arriving at a feasible and well-agreed rehabilitation plan.
