Abstract/Summary

This thesis deals with the problems of concentration of market power in a few players and of lack of competition in the economy which leads to abuse by the dominant players in the market which in turn leads to the detriment of the consuming public. To deal with the problem, it is recommended that an antitrust law of general application by enacted into law. The paper makes a study of the antitrust laws being enforced in the United States, which pioneered antitrust legislation in the 1890s. Further, it also makes a study and comparison of antitrust laws passed and implemented in the Asean countries to enhance competition, protect consumer welfare, and to encourage the entry of investments. It also makes a survey of all the antitrust offenses. Finally, the research recommends the passing of an antitrust law in the Philippines. It reviews Senate Bill No. 3197 which is a proposed bill pending legislation in Senate that deals with antitrust and competition. The paper makes a critic and evaluation of the Senate Bill and makes recommendations for its reform and improvement so as to effectively deal with and penalize antitrust practices in our country. It also makes recommendations for the setting up of the Philippine Competition Commission to enforce and administer antitrust laws rationally, accurately, expertly, expeditiously, and efficiently to enhance market competition, promote fair competition, and protect the consuming public.
