Abstract/Summary
The State as the champion of children’s rights recognizes the uniqueness and individuality of each and every child, especially those with gifted talents and skills. Article 3 of Presidential Decree No. 603 entitled the Child and Youth Welfare Code mandates that: “Every child has the right to a well-rounded development of his personality to the end that he may become a happy, useful and active member of society. The gifted child shall be given opportunity and encouragement to develop his special talents.” Child actors and actresses are one distinct group of gifted children. Beneath the seeming carefree existence their television, print, radio and film exposure seem to exemplify, these children of tender age undergo rigorous physical, mental and emotional conditions. Gifted as they are in the performing arts, their physical growth and emotional development are affected as they get exposed to human emotions and conditions that their young intellects are not fully equipped to handle and process. This proposed legislation seeks to draft an Implementing Rules and Regulations for the the provision of the law entitled An Act Providing for the Elimination of the Worst Forms of Child Labor and Affording Stronger Protection for the Working Child (Republic Act No. 9231) on the preservation of the child actor’s income, in order to involve the management’s participation in safeguarding the rights of child performers. A brief discussion on the situation of child labor in the Philippines is presented, as well as pertinent laws in the country relating to employment of minors.
