Abstract/Summary

The possible danger to people,s health and environment has been exacerbated by the pollution brought about by the use of plastic bags and styrofoam containers. Due to this danger, many countries have begun regulating the use of plastic bags and styrofoams. They have either banned the use of plastic bags or styrofoam containers in commercial establishments, or have required the customer to pay a certain fee such use.

Recently, House Bill no. 1966, was filed with the House of Representatives better known as "Plastic Bag Reduction Act". However, the bill has been questioned as to whether or not the means to be employed in this bill is constitutional. This paper seeks to address the question as to whether or not the provision on prohibition and exemption provided under this bill is constitutional.
