Abstract/Summary
This study examined the legal implication of a senator's voluntary resignation and the subsequent final decision of the Senate Electoral Tribunal to annul the same senator's previous proclamation as winner, on the constitutional limitation to serve for no more than two (2) consecutive terms. It thoroughly discussed the problem by tackling step by step the matters and factors pertaining to the possible effect of the senator's action in determining how the two (2) term rule may apply to him. This study also determine how justice and fair play should be considered and applied in coming up with a provision in our law that will solve this issue.
