Abstract/Summary
Our thesis entitled Examining R.A No. 9334 under GATT 1994: The Philippines Alcoholic Beverages Dispute focus on the dispute of the EU and the US against the Philippines regarding the alleged discriminatory treatment on imported liquors as a violation to the National Treatment obligation under the General Agreement on Tariffs and Trade of 1994.
This study aims to prove that the Philippines did not violate the said issue and to assure that it complies with its undertaking with the World Trade Organization. We will formulate possible legal defenses of the Philippines that can be raised against the allegations of the EU and the US. This will be accomplished by using the different tests applied in related cases, comparing the past rulings of related cases, treatises, and journals, and looking into other legal remedies in the WTO agreement.
