Abstract/Summary
The Mining Industry is perhaps one of the riskiest investments in the world. There is a very high possibility of investing great sums of money in a mining area and getting nothing in return. However, in the Philippines, there is another risk being encountered by Mining Companies. The Philippine Government seems to have different views regarding their perspective in mining.
Thus, all problems in mining activities have risen all throughout the years. There have been conflicting laws passed by the Local Government to prohibit mining permits issued by the Department of Environment and Natural Resources. There have been different views as to the intent and purpose of the Philippine Mining Act. And perhaps, the gravest allegation of all, that the DENR has been biased in issuing mining permit to those companies which would give to them something in return.
The DENR bases the mining permits from their DAO 96-40. If there are conflicts which arise, then the validity of DAO 96-40 should be the one in question. Hence, in this paper, the authors plan to test the validity of the Department of Environment and Natural Resources, implementing rules and regulations, Department Administrative Order 96-40.
