Abstract/Summary

Presidential Decree no. 1986 creating the Movie and Television Review and Classification Board (MTRCB) gave the MTRCB the power to regulate the screening and distribution of any movie and television media in the country. This power is based on the police power of the State which is inherent in every State. While the police power and the power to regulate media are legal in the Philippines, it must still be given limitations in order to avoid and prevent abuse of such powers by the officials that are empowered to use them. While safeguards were placed by the legislative department in the exercise of the MTRCB of such powers, it seems that such safeguards are insufficient and thus show the abuse of such powers by the MTRCB. This study will shortcomings of t department in enacting PD 1986 and the safeguards that should be placed in order for the media industry to have clear guidelines to follow for the screening and distribution of their media
